Application for costs assessment by law practice retaining another law practice
320 Application for costs assessment by law practice retaining another law practice
A law practice that retains another law practice to act on behalf of a client may apply to a costs assessor for an assessment of the whole or any part of the legal costs to which a bill given by the other law practice in accordance with Division 6 (Billing) relates.
If any legal costs have been paid without a bill, the law practice may nevertheless apply for a costs assessment.
An application for a costs assessment may be made even if the legal costs have been wholly or partly paid.
An application under this section must be made within 60 days after – the bill was given or the request for payment was made; or the costs were paid if neither a bill was given nor a request was made.
An application cannot be made under this section if there is a costs agreement between the client and the other law practice.
