Local Government Act 1993

A candidate at the election may, before the declaration of a poll, request a recount of the votes cast at the election.

The returning officer may – agree to recount the votes; or refuse to recount the votes.

If the returning officer refuses to recount the votes, the candidate may appeal to the Tasmanian Electoral Commission.

The Tasmanian Electoral Commission may direct the returning officer to recount the votes.

A recount under this section of the votes at an election is conclusive of the results of the counting of the votes at that election and no further request for a recount of those votes may be made.
