The Minister may – approve the application with or without conditions; or refuse to approve the application.

The Minister, by notice in writing, must notify the lessee of – the approval of the application; or the refusal to approve the application and the reasons for the refusal.

A sublease – is of no effect until the Minister has approved under subsection (1) an application in relation to the sublease; and takes effect, if the Minister has approved under subsection (1) an application in relation to the sublease, on the date on which the Minister notifies the lessee of the approval.

This Part applies to a sublease to which an approval under subsection (1) relates as if it were a lease and the person holding the sublease were the lessee.
