How interim authorisation may be given
13 How interim authorisation may be given
This section applies to an interim authorisation given by the Commissioner of Police in accordance with this Part.
An authorisation may be given orally or by instrument in writing.
If the authorisation is given orally, it must be confirmed by instrument in writing as soon as it is reasonably practicable to do so and, in any event, before an application is made to the Supreme Court in respect of the matter.
An authorisation must – state that it is given under this Act; and describe the general nature of the terrorist act or threat of terrorist act to which it applies; and name or describe the persons, vehicles or areas designated by the authorisation; and specify the powers under Division 2 or 3 that may be exercised under the authorisation; and specify the date on which and time at which it begins to have effect; and specify the date on which and time at which it ceases to have effect.
