Public Health Act 1997

for an offence under this Act may only be instituted by – the Minister or a person authorised by the Minister; or an authorised officer; or a nominated officer in relation to proceedings for an offence under Part 4; or a police officer; or a council.

Proceedings for an offence under this Act must be instituted within 3 years after the date on which an offence is alleged to have been committed.
