Punishment for contempt
46 Punishment for contempt
Subject to section 44, the Commissioner may certify a contempt to the Supreme Court.
If a contempt is certified to the Supreme Court – the Supreme Court must inquire into the matter; and having regard to the evidence produced against and by or on behalf of the person named in the Commissioner's certificate, the Supreme Court may, if satisfied that the person is guilty of the contempt, punish the person in the same manner and to the same extent as would be the case if the person had committed the contempt in relation to the Supreme Court.
The Rules of Court of the Supreme Court apply, with any necessary modification, to the Supreme Court's consideration and punishment of a contempt in relation to the Commissioner.
