55 Employment restrictions
Subject to subsection (2), a provision of a retail lease is void to the extent that it limits or has the effect of limiting a tenant’s right to employ persons of the tenant’s own choosing.
Subsection (1) does not prevent the retail lease from containing provisions that – specify minimum standards of competence and behaviour for persons employed in the retail premises or contractors carrying out work there; or prohibit work from being carried out on specified items of the landlord’s property; or if the retail premises are located in a retail shopping centre, require the tenant to comply with any award or agreement affecting the centre.
