362 Dismissal of application
A judge may dismiss an application under rule 356 or 360 with costs if – the case is not within this Division; or the plaintiff or defendant knew that the party against whom judgment was sought relied on a contention that would entitle that party to unconditional leave to defend.
The judge may require the costs to be paid immediately.
