403D Rule 403C applies in relation to party to proceeding
Rule 403C also applies, with any necessary modification, if –
the applicant is a party to a proceeding and wishes to make a claim in the proceeding against a person who is not a party to the proceeding; and the applicant could properly have made the claim in the proceeding if the person had been a party.
