Part 20Mediation
519 Conduct of mediation
The function of a mediator is to assist the parties – to reach a mutually agreed resolution of their differences; or if that is not possible, to resolve as many differences as possible.
Subject to subrule (3), a mediation is to be conducted in any manner the mediator determines.
The judges may approve guidelines for the conduct of mediation and, unless otherwise ordered or the parties agree, mediation is to be conducted in accordance with those guidelines.
Unless otherwise ordered or agreed by the parties, each party is to attend the mediation with authority to settle.
