Supreme Court Rules 2000

A creditor who establishes a debt under a judgment or order is entitled to the costs of doing so unless the Court or a judge otherwise directs.

The costs referred to in subrule (1) are to be – added to the debt established; and fixed by the Court or judge unless the Court or judge directs the taxation of those costs.

The Court or a judge may – disallow any costs of a creditor unnecessarily or improperly incurred; and order a creditor to pay the costs of a party incurred in opposing a claim, or any part of a claim, that the creditor fails to establish.
