41 Commercial brokerage or advertising of surrogacy arrangements prohibited
In this section – payment means – payment in money or money's worth, other than payment of the birth mother's reasonable surrogacy costs; and for reward or other material benefit or advantage, other than payment of any of the birth mother's reasonable surrogacy costs.
A person must not, for payment, or in anticipation of receiving payment – initiate or take part in any negotiations with a view to the making of a surrogacy arrangement; or offer or agree to negotiate the making of a surrogacy arrangement; or compile any information with a view to its use in making, or negotiating the making of, any surrogacy arrangements; or knowingly cause another person to do any of the acts referred to in paragraph (a), (b) or (c). Fine not exceeding 100 penalty units.
