Before appointing a groundwater area, the Minister must, by notice published in a local newspaper, invite written representations from any person who may be affected by the appointment.

The notice is to state – details of the appointment, the relevant water resource and such other information as the Minister thinks fit; and the name and address of a person to whom representations may be sent and the time before which they are to be received.

Before making an appointment under this section, the Minister must have regard to any representations received.
