44 A registered cultural heritage place is an area of cultural heritage sensitivity

(1)

A registered cultural heritage place that is located in an area specified in column 2 of an item in Schedule 1 is an area of cultural heritage sensitivity.

(2)

Subject to subregulation (3), land within 50 metres of a registered cultural heritage place that is located in an area specified in an item in column 2 of Schedule 1 is an area of cultural heritage sensitivity.

(3)

If part of the land within 50 metres of a registered cultural heritage place that is located in an area specified in an item in column 2 of Schedule 1 has been subject to significant ground disturbance, that part is not an area of cultural heritage sensitivity.
