64 When is a complex assessment required?

(1)

A complex assessment is required if the desktop assessment or standard assessment shows that—

(a)

Aboriginal cultural heritage is, or is likely to be, present in the activity area; and

(b)

it is not possible to identify the extent, nature and significance of the Aboriginal cultural heritage in the activity area unless a complex assessment is carried out.

(2)

Despite subregulation (1), a complex assessment is not required in respect of an area to which the standard assessment applied if the activity will not harm Aboriginal cultural heritage in that area.
