11 Power to issue heavy tow truck licences

S. 11(1) amended by Nos 49/2019 s. 140(Sch. 2 item 3), 18/2020 s. 116(1).

(1)

Subject to subsections (2), (3), (4) and (5), the Secretary may license a person to operate a tow truck that is specified in the licence in the course of conducting an accident towing service business—

(a)

to provide accident towing services to vehicles that the tow truck is capable of towing that have a gross vehicle mass of 4 tonnes or more; and

(b)

from the depot specified in the licence.

(2)

In the case of a licence authorised by the Minister to be issued under section 15(2)(d), the Secretary may license the relevant agency or contractor (as the case requires) to operate a tow truck that is specified in the licence in the course of conducting an accident towing service business—

(a)

to provide accident towing services to vehicles that the tow truck is capable of towing that have a gross vehicle mass of 4 tonnes or more; and

(b)

from the depot specified in the licence; and

(c)

on the whole or any part of the Link road or Extension road, as specified in the licence, or on any other designated road that is specified in the licence.

(3)

In the case of a licence authorised by the Minister to be issued under section 15(2)(e), the Secretary may license the Freeway Corporation or contractor (as the case requires) to operate a tow truck that is specified in the licence in the course of conducting an accident towing service business—

(a)

to provide accident towing services to vehicles that the tow truck is capable of towing that have a gross vehicle mass of 4 tonnes or more; and

(b)

from the depot specified in the licence; and

(c)

on the whole or any part of EastLink, as specified in the licence, or on any other designated road that is specified in the licence.

(4)

In the case of a licence authorised by the Minister to be issued under section 15(2)(f), the Secretary may license the relevant West Gate Tunnel agency or contractor (as the case requires) to operate a tow truck that is specified in the licence, in the course of conducting an accident towing service business—

(a)

to provide accident towing services to vehicles that the tow truck is capable of towing that have a gross vehicle mass of 4 tonnes or more; and

(b)

from the depot specified in the licence; and

(c)

on the whole or any part of the West Gate Tunnel tollway, as specified in the licence, or on any other designated road that is specified in the licence.

(5)

In the case of a licence authorised by the Minister to be issued under section 15(2)(g), the Secretary may license the relevant North East Link agency or contractor (as the case requires) to operate a tow truck that is specified in the licence in the course of conducting an accident towing service business—

(a)

to provide accident towing services to vehicles that the tow truck is capable of towing that have a gross vehicle mass of 4 tonnes or more; and

(b)

from the depot specified in the licence; and

(c)

on the whole or any part of the North East Link road, as specified in the licence, or on any other designated road that is specified in the licence.
