Architects Act 1991

In this Division—

Despite the amendments made by Part 3 of the amending Act to Division 3 of Part 3, a person's registration as an architect continues in force on and from the commencement day until the end of the financial year in which Division 1 of Part 3 of the amending Act commences, unless the registration—

is taken to continue in force under section 15AAB(2); or

is earlier cancelled under this Act; or

is suspended under a provision of this Act (other than section 15(2) as in force immediately before the commencement day) at the end of the financial year, in which case the registration continues in force until one month after the suspension ends or is revoked under this Act.

Despite the amendments made by Part 3 of the amending Act to Division 3 of Part 3, an approval given under section 13 or 14 that is not cancelled before the commencement day continues in force on and from that day until the end of the financial year in which Division 1 of Part 3 of the amending Act commences, unless the approval—

is taken to continue in force under section 15AAC(2); or

is earlier cancelled under this Act; or

is suspended under a provision of this Act (other than section 15(3) as in force immediately before the commencement day) at the end of the financial year, in which case the approval continues in force until one month after the suspension ends or is revoked under this Act.

In subsection (2), a reference to a person's registration as an architect is taken to include a reference to a person's registration that is suspended.

In subsection (3), a reference to an approval given under section 13 or 14 is taken to include a reference to an approval that is suspended.

Despite the amendments made by Part 3 of the amending Act to Division 3 of Part 3, the Board may revoke a suspension under section 15(2) during the period beginning on the commencement day and ending at the end of the financial year in which Division 1 of Part 3 of the amending Act commences, if the person concerned—

gives a satisfactory explanation of the failure to pay the relevant annual fees referred to in section 15(2) as in force immediately before the commencement day; and

pays to the Board—

the fees referred to in paragraph (a); and

the prescribed registration reinstatement fee.

Despite the amendments made by Part 3 of the amending Act to Division 3 of Part 3, the Board may revoke a suspension under section 15(3) during the period beginning on the commencement day and ending at the end of the financial year in which Division 1 of Part 3 of the amending Act commences, if the body concerned—

gives a satisfactory explanation of the failure to pay the relevant annual fees referred to in section 15(3) as in force immediately before the commencement day; and

pays to the Board—

the fees referred to in paragraph (a); and

the prescribed approval reinstatement fee.
