The relevant council may at any time on its own motion, or at the request of the owner of land on which a swimming pool or spa is located, extend the period for lodgement of a certificate of pool and spa barrier compliance for the swimming pool or spa, if the relevant council is satisfied that—

the owner has provided a reasonable excuse as to why it was not possible to lodge the certificate of pool and spa barrier compliance by the applicable date under regulation 147V(1); or

arrangements have been put in place by the owner for an inspection by a swimming pool and spa inspector to inspect the barrier; or

arrangements have been put in place by the owner for building work to be carried out to rectify—

non-compliances of the barrier with the applicable barrier standard listed in a certificate of pool and spa barrier non‑compliance; or

non-compliances of the barrier with the applicable barrier standard specified in a written notice provided by a swimming pool and spa inspector under regulation 147ZG(1); or

building work being carried out on the land means an inspection of the barrier would not be appropriate; or

a building notice, a building order or an emergency order under Part 8 of the Act has been issued in relation to the swimming pool or spa barrier.

The relevant council may extend the period for provision of a certificate of pool and spa barrier compliance by not more than 6 months at a time.

If the relevant council decides to grant an extension under subregulation (1), the relevant council must give a notice in writing to the owner of the land specifying a new due date for the lodgement of a certificate of pool and spa barrier compliance as soon as practicable after that decision is made.
