Subject to regulation 233, if an existing building, whenever constructed, is subdivided, each building resulting from the subdivision must be brought into conformity with these Regulations.

(2)
Despite subregulation (1), the municipal building surveyor may exempt a building from all or any of the requirements of subregulation (1).
(3)
In deciding whether to grant an exemption under subregulation (2) the municipal building surveyor must take into account—
(a)
the structural adequacy of any building to which the exemption applies; and
(b)
the requirements necessary to make reasonable provision for—
(i)
the amenity of any building and the safety and health of people using any building to which the exemption applies; and
(ii)
avoiding the spread of fire to or from any adjoining building.
(4)
An exemption granted under subregulation (2) must be in the form of Form 18.
