Section 78(1A) of the Act does not apply in relation to domestic building work—
to be carried out under a major domestic building contract entered into by a builder before 1 September 2016; or
in respect of which a builder acts or proposes to act as a domestic builder before 1 September 2016.

A building surveyor is an independent professional who ensures that your building complies with legislation, regulations and the National Construction Code (NCC). They also intervene when building work does not comply with required building standards. These standards are set out in the building regulatory framework which includes the Building Act 1993 (Act), the Building Regulations 2018 (Regulations) and the NCC.
Building surveyors must be registered through the Victorian Building Authority and work within their category of registration.
They can be a municipal building surveyor (appointed by the local council to provide the service to ratepayers) or private building surveyors (PBS—appointed by you or your agent). Once appointed to a building project, they become the Relevant Building Surveyor (RBS).
The Victorian Building Authority (Authority) is the independent statutory authority with oversight of the building industry. As part of a series of landmark reforms to the building sector, the Authority has now integrated the functions of the Victorian Managed Insurance Authority and Domestic Building Dispute Resolution Victoria. To reflect this expansion, the Authority is now trading as the Building and Plumbing Commission.
The appointed surveyor is the independent professional authorised to perform important regulatory functions for, and in relation to the steps of, a building project. They have statutory requirements to avoid conflicts of interest, and undertake the following functions to ensure the builder delivers a compliant building for owners:
- assessing and issuing building permits
- ensuring the builder has received a notice of cover for the First Resort Home Warranty Scheme
requiring protection works where needed to safeguard neighbouring properties
conducting building inspections or causing building inspections to be conducted at mandatory notification stages and at additional stages where appropriate
enforcing building standards
issuing the occupancy permit or certificate of final inspection on completion of the building work.
When carrying out these responsibilities, the RBS must apply the technical standards in the NCC which relate to:
structure
damp and weatherproofing
fire safety
health and amenity
safe movement and access
energy efficiency.
Building surveyors appointed as the RBS for a project are not Project Managers and must work within their legislated scope. For this reason, they cannot assist with:
the design of building works
site supervision and construction of building work
enforcing contractual obligations between the owner and other building practitioners
other legislated obligations (such as Occupational Health and Safety, planning matters, services supply, including water and electricity and environmental protection)
workmanship concerns, unless directly related to compliance within the regulatory framework. For example, a poorly installed flashing may have an underlying non-compliance with the NCC; however, poorly executed internal paint finishes are likely to be out of scope.
Appointing, dismissing or changing building surveyors
Only you (the owner) or your authorised agent can appoint a PBS. Builders are not allowed to appoint a PBS for work under a major domestic building contract. They may suggest a pool of surveyors; however, they cannot require you to follow their suggestions.
The building surveyor must be appointed as the RBS before applying for the building permit and they will remain your RBS for the duration of the building work.
The RBS must notify the relevant local council in writing of their appointment within 7 days.
If you want to dismiss or change a PBS before the building work has commenced or is complete, you will need the Authority's consent. The Authority can only accept an application to terminate the appointment of a PBS in limited circumstances, and their decision may be appealed to the Building Appeals Board. You cannot request to terminate the appointment of a Municipal Building Surveyor (MBS).
A PBS can transfer their appointment to another PBS or an MBS permanently or for a fixed period on agreement of all parties. Where all parties agree, Authority consent is not required.
Professional and ethical responsibilities and obligations of a building surveyor
Building surveyors in Victoria have important professional and ethical obligations that govern their conduct and responsibilities. Key legal requirements are set out in the Act, the Regulations and the Code of Conduct for Building Surveyors (Code). These requirements include:
a responsibility to act independently from all other parties (e.g. the builder or designer)
an obligation to abide by a professional code of conduct, the Code, which requires building surveyors to:
act within the public interest
comply with the law
act with integrity
avoid conflicts of interest, including involvement in the design process with the builder
an obligation to undertake certain activities, including the commencement of an enforcement action when building work does not comply with the Act, the Regulations or an approved building permit.
Responsibilities and obligations of other parties in relation to the building surveyor
Your builder
It is your builder's responsibility to ensure the building works are undertaken and constructed in compliance with the approved plans and specifications and the relevant building regulations.
You as the owner
You are responsible for checking the progress of your building project, talking to your builder about any issues or concerns you may have and paying your builder for completed work. You have the right to reasonable access to your building site at any time during construction to check on progress.
You need to:
choose an RBS. You may be suggested a specific one by your builder; however, you or your authorised agent must make the final decision
raise issues with workmanship (that are not related to compliance with legislation, regulations or the NCC) with your builder as this is not within the RBS scope. An example of this is poorly executed internal paint finishes.
Relevant building surveyors and your project
Your RBS is involved for the duration of building work and has a role in each stage of the project.
Prior to the commencement of building work, the RBS will assess the building permit application and issue a building permit confirming that they are satisfied the building work will comply with the Act, Regulations and NCC. After building work begins, the RBS's role includes inspections, enforcement and the issuing of the occupancy permit or certificate of final inspection at the completion of the work.
Inspections
There are multiple mandatory notification stages through the building work process that trigger an inspection which are specified in the building permit.
It is an offence for a builder to continue to carry out building work beyond the mandatory notification stage without notifying the RBS.
The RBS may also inspect building work at any time.
The RBS must initiate the inspection. The RBS may conduct the inspection themselves or delegate the inspection to another registered building surveyor or inspector, or a prescribed person such as an endorsed building engineer.
Enforcement
The RBS must undertake enforcement if they are satisfied the work does not comply with the Act, the Regulations, the NCC or the approved building permit and the RBS has a variety of enforcement tools available to them.
The RBS is independent in assessing compliance and can use their enforcement tools to require the builder to address non-compliant work.
The builder or owner must not carry out any proposed changes to the approved building permit without prior consultation and approval by the RBS.
The RBS can approve changes to the building permit, provided they are consistent with the Act, the Regulations and the NCC.
Occupancy permit/certificate of final inspection
A building permit will nominate whether an occupancy permit (OP) or certificate of final inspection (CFI) is required.
When a building permit specifies the need for an OP, the building must not be occupied unless it is obtained.
A building surveyor can only issue an OP if the building is suitable for occupation.
In some instances, such as extensions or alterations to an existing home, an OP is not required; however, in these instances a CFI must be issued.
There may be compliance matters that still need resolution post OP/CFI, but the RBS does not have any role in resolving these issues.
Complaints or disputes
If you have a complaint or a dispute involving your RBS:
you should first contact your RBS. They are required to have a process for handling complaints. Your RBS should be able to inform you why they made a particular decision
if you are unable to resolve your issue and believe your RBS has breached their statutory responsibilities, you can lodge a complaint with the Authority
there may be complaints or disputes that are outside of the scope of a building surveyor's statutory functions under the Act. The Authority may be able to assist in mediating the dispute.
If you have a complaint or a dispute involving any registered practitioner such as your builder, you can refer it to the Authority for inquiry.
