20A Payment of Commission's costs of disciplinary action

(1)

If the Commission takes disciplinary action against a casino operator under section 20(4), the Commission, by written notice, may require the casino operator to pay to the Commission the amount determined by the Commission being an amount not exceeding the reasonable costs and expenses of the Commission in—

(a)

investigating whether the grounds for disciplinary action are made out; and

(b)

considering any submissions made by the casino operator under section 20(3); and

(c)

preparing for and taking the disciplinary action.

(2)

A notice under subsection (1) must set out—

(a)

the amount to be paid by the casino operator; and

(b)

how that amount was calculated; and

(c)

when that amount must be paid to the Commission.

(3)

If the casino operator does not pay the amount by the time for payment set out in the notice, the Commission, by giving written notice to the casino operator, may suspend the casino licence, without affording the casino operator a further opportunity to be heard, until the amount is paid.

(4)

An amount payable under subsection (1) may be recovered in a court of competent jurisdiction as a debt due to the State.
