Catchment and Land Protection Act 1994

A person may apply to the Victorian Civil and Administrative Tribunal for a declaration concerning the validity of a decision referred to in section 48(1).

On an application under subsection (1) the Tribunal may make any declaration it thinks appropriate in the circumstances.

The Tribunal's power to make a declaration under this section is exercisable only by a presidential member of the Tribunal.

Subsection (1) does not apply to a decision in respect of a land management notice that deals only with the control of noxious weeds or pest animals or both.
