90 Approval to carry out lift and re-position procedure without exhumation licence
A cemetery trust which has approved an application for a lift and re-position procedure may authorise a person, without an exhumation licence—
to open a place of interment; and
to lift any existing human remains which are interred in the place of interment; and
to deepen or enlarge the place of interment if necessary; and
to reposition the existing human remains in the place of interment, whether contained in a receptacle or not, so as to provide space for further interments in that place of interment.
Without limiting the manner in which a lift and re‑position procedure is carried out, for the purposes of subsection (1)(d), a person may remove human remains from any receptacle and place them in another receptacle.
