13 Offence of advertising a change or suppression practice
A person commits an offence if—
the person publishes or displays, or authorises the publication or display of, an advertisement or other notice; and
the advertisement or other notice indicates, or could reasonably be understood as indicating, that the person or any other person intends to engage in one or more change or suppression practices, other than for the purposes of warning of the harm caused by such practices.
Penalty: In the case of a natural person, level 9 fine (60 penalty units maximum);
In the case of a body corporate, 300 penalty units maximum.
It is a defence to a charge under subsection (1) if the accused proves that the accused took reasonable precautions and exercised due diligence to prevent the publication or display.
