Children's Services Regulations 2020

This regulation applies to a children's service in respect of which a licence to operate a limited hours Type 1 service was issued and in force immediately before the commencement day.

For the purposes of section 109(1), (2), (3) and (4) of the Act, the prescribed minimum number and minimum qualification requirements of educators are—

for children from birth to under 36 months of age, one educator to 5 children or fraction of that number of children; and

for children aged 36 months of age or over (excluding children over preschool age), one educator to 15 children or fraction of that number of children; and

all educators used to meet the ratios in paragraphs (a) and (b) hold at least an approved certificate III level education and care qualification.
