68 Children leaving the children's service premises
The approved provider of a children's service must ensure that a child who is being educated and cared for by the children's service does not leave the children's service premises except in accordance with subregulation (3).
Penalty: 10 penalty units.
A nominated supervisor of a children's service must ensure that a child who is being educated and cared for by the children's service does not leave the children's service premises except in accordance with subregulation (3).
Penalty: 10 penalty units.
The child may only leave the relevant premises if the child—
is given into the care of—
a parent of the child; or
an authorised nominee named in the child's enrolment record; or
a person authorised by a parent or authorised nominee named in the child's enrolment record to collect the child from the premises; or
leaves the premises in accordance with the written authorisation of the child's parent or authorised nominee named in the child's enrolment record; or
is taken on an excursion in accordance with this Division; or

is transported by the service or on transportation arranged by the service in accordance with Division 7B; or
is given into the care of a person or taken outside the premises—
because the child requires medical, hospital or ambulance care or treatment; or
because of another emergency.
Nothing in this regulation affects the operation of any court order that prohibits a parent from—
collecting a child from the children's service premises; or
authorising a child to leave the children's service premises.
