38 Minister may recommend inquiry
(1)
The Minister may recommend that the Commission conduct an inquiry under this Division.
(2)
The Commission must determine, in accordance with section 37, whether or not it will conduct the inquiry.
(3)
If the Commission determines not to conduct an inquiry as recommended by the Minister, the Commission must give the Minister a statement of the reasons for making that determination as soon as practicable.
