16 General provisions as to proceedings for offences
The following provisions have effect with respect to proceedings for offences against this Act—
S. 16(a) amended by No. 68/2009 s. 97(Sch. item 26).
(a)
the onus of proof that the person named in a charge as an employee of the accused was not employed as alleged in that charge is on the accused;
(b)
it is not a defence that an employer was not in Victoria at the time the alleged offence was committed.
