123 Receiver taken to be beneficially entitled
(1)
Proceedings taken under this Act in the name of a receiver in relation to any property may be taken as if the receiver were beneficially entitled to the property.
(2)
If receivable property has been taken by, or paid or transferred to, a person or otherwise used unlawfully or in breach of trust, a receiver may take proceedings in the name of the receiver as if the receiver were beneficially entitled to the property at the time the property was taken, paid, transferred or used.
