3.02 Notice of appeal by offender
A notice of appeal and undertaking to proceed under section 255 of the Act must be in Form 3A.
A notice under section 255(6)(a) of the Act must—
be in Form 3B; and
be provided to the appellant prior to a notice of appeal and undertaking to proceed being accepted for filing.
The notice of appeal and undertaking to proceed must be signed by the appellant in the presence of—
the Registrar of the Magistrates' Court with whom the notice of appeal is filed;
if the appellant is in a prison, youth justice centre or youth residential centre—
the officer in charge of the prison, youth justice centre or youth residential centre; or
any prison officer of or above the rank of senior prison officer; or
if the appellant is in a police gaol, a police officer—
of or above the rank of sergeant; or
for the time being in charge of a police station.
