Irrelevant whether incorrect about protected attribute

In force

In determining whether a person has committed an offence against section 195N(1) or 195O(1), it is irrelevant that the person was incorrect about—

(a)

a protected attribute of the other person or group of persons; or

(b)

whether the other person or group of persons had a particular protected attribute.
