36 Failure to comply with Code of Practice in relation to sale and delivery of regulated food

(1)
Except as otherwise provided in subsection (2), a person must not anywhere in Victoria sell, deliver or provide for human consumption, regulated food—
(a)
which has not been treated as required under a Code of Practice; or
(b)
which has not been packed and sealed as required under a Code of Practice.
- 400 penalty units.

Section 55C applies to an offence against this subsection.
(2)
Subsection (1) does not apply to the sale or delivery of dairy food to any licensed dairy manufacturing premises.
