Disability Act 2006

This section applies in respect of a disability service provider that is a contracted service provider or a funded service provider.

For the purpose of ascertaining whether this Act and the regulations are being complied with, an authorised officer, with such assistance as the authorised officer reasonably requires, may at any time visit and inspect any part of the premises where disability services are being provided, other than any premises or part of any premises used as a private residence that is not a residential service, and may—

see and ask questions of a person to whom disability services are being provided;

make enquiries in relation to any person to whom disability services are being provided;

inspect, make copies of or take extracts from, any document relating to—

the provision of disability services; or

any person to whom disability services are being provided;

require a disability service provider or any member of staff of the disability service provider—

to answer a question to the best of that person's knowledge, information and belief;

to take reasonable steps to produce documents.

If an authorised officer requires a person referred to in subsection (1)(d) to answer a question to the best of that person's knowledge, information and belief, the authorised officer must advise the person that it is a reasonable excuse for that person to refuse to comply with the request if it would tend to incriminate that person.
