24 Disposing of land in other ways

S. 24(1) amended by Nos 59/2003 s. 103(1), 10/2017 s. 33(12).

(1)

Development Victoria may for the purposes of this Act—

(a)

grant leases or licences over land vested in it or registered in its name; or

(b)

on or after 1 December 1992, dispose of its interest in fee simple in any land—

on any terms (including consideration) that it considers appropriate.

(2)

For the purposes of this Act, Development Victoria may enter into an agreement with another person concerning the use or development of land in the docklands area—

(a)

on disposing of the whole of its interest in the land to that person; or

(b)

in anticipation of disposing of the whole of its interest in the land to that person.

(3)

Division 2 of Part 9 of the Planning and Environment Act 1987[1] applies to an agreement under subsection (2) as if—

(a)

it was an agreement under that Division;

(b)

it referred to Development Victoria instead of the responsible authority for the planning scheme;

S. 24(3)(ba) inserted by No. 66/1997 s. 4(2)(b).

(ba)

in section 173(4) the expression "unless the vendor assumes the purchaser's rights and obligations under the agreement" were omitted;

S. 24(3)(c) amended by No. 10/2017 s. 33(14).

(c)

section 174(2)(c) were omitted.
