3 Definitions
In this Act—

building includes—
a structure and part of a building or a structure; and
fences, walls, out-buildings, service installations and other appurtenances of a building; and
a boat or a pontoon which is permanently moored or fixed to land;

chief executive means a person appointed under Part 2 of the Development Victoria Act 2003 as chief executive of Development Victoria;
development includes—
the construction or carrying out, extension, demolition or removal of a building or works; or
the decoration or alteration of the inside or outside of a building or the alteration of works; or
the subdivision or consolidation of land, airspace or buildings; or
the installation or provision or operation of facilities or services; or
the relocation, deepening or widening of a waterway;

Development Victoria means Development Victoria established by the Development Victoria Act 2003;

docklands area means the area shown on a plan of survey approved for the time being under section 4;

holding and selling costs in relation to land means—
any interest, administrative or other costs incurred by Development Victoria in or incidental to developing the land or selling it; and
any proportion of the costs incurred by Development Victoria in promoting the whole or part of the docklands area, that is a proportion that Development Victoria determines after considering the comparative areas of the land sold and the land promoted;

land includes—
buildings and other structures permanently fixed to land; and
land covered with water; and
any estate, interest, easement, servitude, privilege or right in or over land; and
any stratum of land;
limitations in relation to land means trusts, reservations, restrictions, exceptions, encumbrances, limitations, estates and interests;

Ports Victoria has the same meaning as in section 3 of the Transport Integration Act 2010;

public statutory body means a body established by or under an Act for a public purpose or a municipal council;
road includes bridge, highway, street, lane, footway, square, court, alley or right of way, whether a thoroughfare or not and whether accessible to the public generally or not;

staff means any person who is employed or engaged by Development Victoria under section 16 of the Development Victoria Act 2003;

stratum of land means a part of land consisting of a space of any shape above or below or partly above and partly below the surface of the land, all the dimensions of which are limited;

works includes any change to the natural or existing condition or topography of land including the removal, destruction or lopping of trees and the removal of vegetation or topsoil and land reclamation and land decontamination.
