Emergency Management Act 2013

The Emergency Management Commissioner, by written notice, may require an agency or a Department to give to the Emergency Management Commissioner any information that the Emergency Management Commissioner reasonably believes is necessary for the purposes of performing the functions specified in section 32(1)(j), (k) and (l).

Within 28 days of receiving a notice under subsection (1), the agency or Department must give the information to the Emergency Management Commissioner, unless—

the Emergency Management Commissioner has agreed to allow an extension of time for the giving of the information; or

the Emergency Management Commissioner has agreed that the agency or Department is not able to give the information.

If the Emergency Management Commissioner reasonably believes that it is urgent that information that he or she has required to be given under a notice under subsection (1), be given within a lesser time than that specified in subsection (2), the Emergency Management Commissioner may specify a lesser period for the giving of the information and the information must be given within the period so specified.

If the Emergency Management Commissioner has agreed to allow an extension of time under subsection (2), the agency or Department must give the information to the Emergency Management Commissioner within the time agreed on.
