Repeat industrial waste offenders

If—

(a)

a natural person commits an offence (the current offence) against section 133(3), 134(2) or 135(3); and

(b)

during the 5 years before the commission of the current offence, the person has been convicted of an offence (the relevant offence) against section 133(3), 134(2) or 135(3)—

a Court may impose a penalty of up to 2 years imprisonment in addition to, or in place of, the penalty included in section 133(3), 134(2) or 135(3).
