Who may bring proceedings for an offence?

In force

(1)

Proceedings for an offence under this Act or the regulations may be brought by—

(a)

the Commission; or

S. 180(1)(b) substituted by No. 37/2014 s. 10(Sch. item 57).

(b)

a police officer within the meaning of the Victoria Police Act 2013; or

(c)

a person who is authorised to do so, either generally or in a particular case, by the Commission.

(2)

In a proceeding for an offence against this Act it must be presumed, in the absence of evidence to the contrary, that the person bringing the proceeding was authorised to bring it.
