Equal Opportunity Act 2010

For the purposes of this Division, prior contravention means a contravention of Part 2 of the old Act that is alleged or claimed to have occurred before the commencement day.

Additionally, prior contravention includes a thing—

that is alleged or claimed to be a contravention of Part 2 of the old Act; and

that is constituted by a number of occasions over a period of time, at least one of which is before the commencement day and at least one of which is on or after it.

For the purposes of subsection (2)(b), the old Act is to be treated as having been in force during each of the occasions referred to in that provision that are on or after the commencement day.
