Transitional provisions—National Domestic Violence Order Scheme Act 2016
227 Transitional provisions—National Domestic Violence Order Scheme Act 2016
Pt 14 Div. 10 (Heading and new s. 227) inserted by No. 53/2016 s. 81.
New s. 227 inserted by No. 53/2016 s. 81.
This section applies to a corresponding interstate order that, immediately before the commencement of section 77 of the National Domestic Violence Order Scheme Act 2016, was registered under Division 1 of Part 10.
Despite the repeal of Division 1 of Part 10, this Act continues to apply in relation to the corresponding interstate order unless or until the earlier of the following occurs—
the corresponding interstate order becomes a recognised DVO in the jurisdiction in which the interstate order was made;
the corresponding interstate order is—
declared to be a recognised DVO under section 39 of the National Domestic Violence Order Scheme Act 2016; or
declared by a registrar of a court of another participating jurisdiction to be a recognised DVO under a corresponding DVO recognition law.
The corresponding interstate order is not a local DVO for the purposes of the National Domestic Violence Order Scheme Act 2016.
On and after the corresponding interstate order becoming a recognised DVO or being declared to be a recognised DVO, the National Domestic Violence Order Scheme Act 2016 applies in relation to the corresponding interstate order as if it were a non-local DVO that is a recognised DVO.
