168 Determination of rehearing
On rehearing a matter under section 167, if the Magistrates' Court is satisfied, on the balance of probabilities, that a ground referred to in section 167(3) has been established the Magistrates' Court may—
S. 168(1)(a) amended by No. 29/2016 s. 41(3)(a).
cancel the order made under section 165(3)(e); and
S. 168(1)(b) amended by No. 59/2017 s. 46(a).
exercise any power available to the Magistrates' Court under section 165 in respect of the person in default.
If the Magistrates' Court is not satisfied that a ground referred to in section 167(3) has been established, the Magistrates' Court—
S. 168(2)(a) amended by Nos 29/2016 s. 41(3)(a), 59/2017 s. 46(b).
must confirm the order to imprison the person in default under section 165(3)(e); and
may—
S. 168(2)(b)(i) amended by Nos 29/2016 s. 41(3)(b), 59/2017 s. 46(c).
issue a warrant to imprison the person in default under section 165A(2)(a) if the person in default is not in custody; and
S. 168(2)(b)(ii) amended by Nos 29/2016 s. 41(3)(c), 59/2017 s. 46(c).
lift a stay on an instalment order (if any) made in respect of the person in default under section 165A(2)(b).
Subject to section 167(4), the Magistrates' Court may only rehear a matter once.
