179A Service of certain documents via online platform
The Director may approve a website as the online platform for the purposes of the following—
this section;
section 162A of the Infringements Act 2006;
sections 67(11) and 84BE(8A) of the Road Safety Act 1986;
section 207(1) of the EastLink Project Act 2004;
section 77(7) of the Melbourne City Link Act 1995;
section 79(8) of the North East Link Act 2020;
section 41(8) of the West Gate Tunnel (Truck Bans and Traffic Management) Act 2019;
section 165DE of the Public Health and Wellbeing Act 2008.
If the Director approves a website as the online platform, the Director must ensure that notice of the approval and related website details are published in the Government Gazette.
A notification or other document required or permitted by this Act to be given or served by the Director on any person other than a person specified in subsection (5), may be given or served by lodging the notification or other document on the online platform.
A notification or other document required or permitted by this Act to be given to or served on the Director by any person other than a person specified in subsection (5), may be given or served by lodging the notification or other document on the approved online platform.
The following persons are specified for the purposes of subsections (3) and (4)—
a fine defaulter;
an infringement offender;
any other person against whom enforcement action under this Act or the Infringements Act 2006 is sought.
A notification or other document given or served in accordance with this section is taken to be given or served and received at the time the notification or other document is readily available in electronic form on the online platform and capable of being retrieved.
