Within 14 days after service of a notice of an attachment of earnings direction, a fine defaulter in respect of whom an attachment of earnings direction has been made may apply to the Director for the direction to be varied or cancelled.

For the purposes of making an application under subsection (1), the fine defaulter must establish, to the satisfaction of the Director, that the attachment of earnings direction would—

cause the fine defaulter to suffer financial hardship; or

result in the fine defaulter's earnings falling below the prescribed protected level of income.

The Director may vary or cancel an attachment of earnings direction under section 70 if the Director is satisfied that the fine defaulter would suffer financial hardship or the fine defaulter's earnings would fall below the protected level of income prescribed under subsection (2) if the direction is not varied or cancelled.
