98 Exemptions from requirement to hold recreational fishery licence
A person is exempt from the requirement to hold a recreational fishery licence under section 44 of the Act if the person—
receives an aged or invalid pension under the laws of the Commonwealth for the time being in force in relation to social services; or
is a totally and permanently incapacitated pensioner or service pensioner under the laws of the Commonwealth for the time being in force in relation to the repatriation of discharged servicemen or servicewomen; or
holds a Senior's Card; or
has attained the age of 70 years; or
holds a current pensioner concession card or equivalent as a result of receiving a carer payment under the laws of the Commonwealth for the time being in force in relation to social services; or

identifies as an Aboriginal or Torres Strait Islander person; or
Reg. 98(1)(g) inserted by S.R. No. 63/2023 reg. 4(1)(b).
holds a Veterans Card - Victoria.
Note
Under section 47 of the Act a person under the age of 18 years may take fish for any purpose other than for sale without holding a recreational fishery licence.
In this regulation—
Reg. 98(2) def. of Senior's Card amended by S.R. No. 63/2023 reg. 4(2)(a).
Senior's Card means—
a Victorian Senior's Card issued by the Victorian Government, other than a Senior's Business Discount Card issued by the Victorian Government; or
a Senior's Card issued by the government of another State or a Territory, other than a Senior's Business Discount Card;

Veterans Card - Victoria means a Veterans Card - Victoria issued by the Victorian Government.
