12A Portion of funds received for supply of goods or services directed to fundraising to be disclosed

(1)

A person, who supplies goods or services in the course of a business and represents that a portion of the money or benefit received in relation to that supply is to be applied for a beneficial or benevolent purpose, must disclose in accordance with subsection (2) to the person to whom the goods or services are to be supplied the dollar amount or percentage amount of the money or benefit to be so applied.

  1. In the case of a corporation, 240 penalty units.

In any other case, 120 penalty units.

(2)

For the purposes of subsection (1), the disclosure must be made—

(a)

in writing in accordance with any condition imposed under section 12B; and

(b)

to the person to whom the goods or services are to be supplied before the contract in relation to that supply is entered into.
