153 Non-disclosure of identifying information
The Commissioner may decide that, as to any process under this Act, any of the following information is not to be disclosed in the conduct of that process by the Commissioner—
the name of any complainant;
the name of any person who received or sought a health service;
the name of any person who was the subject of conduct dealt with in a Commissioner initiated investigation or a referral investigation;
any identifying information about a person to whom paragraph (a), (b) or (c) applies.
The Commissioner must not make a decision under subsection (1) unless the Commissioner is satisfied that—
there are special circumstances; and
it is in the complainant's or the person's interests not to disclose the information.
In making a decision under this section, the Commissioner must consider whether not disclosing the information would unreasonably limit another person's right to natural justice.
The Commissioner may revoke a decision under subsection (1) if the Commissioner is no longer satisfied of the matters set out in subsection (2).
