74 Transfer or variation of certificate
S. 74(1) amended by No. 46/1998 s. 7(Sch. 1).
The Secretary, on the application of the person who is the holder for the time being of a certificate of approval in principle relating to a health service establishment may—
vary the certificate or any condition to which it is subject; or
approve the transfer of the certificate to another person.
Sections 70 and 71 apply to an application for variation or transfer of a certificate as if the application were an application for approval in principle.

The person who is the holder for the time being of a certificate of approval in principle must produce the certificate to the Secretary for endorsement by the Secretary of the particulars of—
S. 74(3)(a) substituted by No. 18/2004 s. 6(a).
the variation under subsection (1)(a) of the certificate or any condition to which the certificate is subject; or
S. 74(3)(b) amended by No. 18/2004 s. 6(b).
the transfer under subsection (1)(b) of the certificate to that person.
