Heritage Act 2017

A prescribed person or body, or a person or body included in a prescribed class, may make an application to the Executive Director for a determination under section 36C (an exclusion determination) that a place or object not be included in the Heritage Register.

An application for an exclusion determination must—

be made to the Executive Director in the prescribed form; and

be prepared by a prescribed person; and

include reasons why the place or object should not be included in the Heritage Register, being reasons based on the assessment criteria published by the Heritage Council; and

include any other prescribed information; and

be accompanied by the prescribed fee (if any).
