Offence of taking detrimental action against members

In force

(1)

A person must not take detrimental action against another person who is or was a member of a Board of Inquiry because the other person is or was a member of a Board of Inquiry.

240 penalty units or imprisonment for 2 years.

Note

Section 128 applies to an offence against this subsection.

(2)

It is a defence in a proceeding for an offence against subsection (1) if the reason referred to in that subsection was not a substantial reason for the detrimental action.
