42F Review of information provided by Parliamentary Workplace Standards and Integrity Commission

S. 42F(1) amended by No. 27/2024 s. 188(Sch. 3 item 1.2(a)).

(1)

Integrity Oversight Victoria may review the following—

(a)

a report provided to it under section 22(3)(b) or 24(3)(b) of the Parliamentary Workplace Standards and Integrity Act 2024;

(b)

a copy of a recording provided to it under section 22(6)(a) or 24(4)(a) of that Act;

(c)

a copy of a transcript provided to it under section 22(6)(b) or 24(4)(b) of that Act;

(d)

anything provided to it under section 80 of that Act.

(2)

A review of a matter under subsection (1) must assess—

(a)

whether the requirements under the Parliamentary Workplace Standards and Integrity Act 2024 relating to that matter have been complied with; and

(b)

if the Parliamentary Workplace Standards and Integrity Commission has requested a person to provide information, documents or other things for the purposes of an investigation—whether the requirement may reasonably be considered to assist the Parliamentary Workplace Standards and Integrity Commission to achieve the purposes of the investigation; and

(c)

if the matter relates to the questioning of a person attending an interview with the Parliamentary Workplace Standards and Integrity Commission—whether the questioning may reasonably be considered to assist the Parliamentary Workplace Standards and Integrity Commission to achieve the purposes of the investigation to which the attendance relates.

If Integrity Oversight Victoria considers that a copy of a recording provided by the Parliamentary Workplace Standards and Integrity Commission is no longer necessary for the purpose of reviewing the copy in accordance with this section, Integrity Oversight Victoria may—

(a)

return the copy to the Parliamentary Workplace Standards and Integrity Commission; or

(b)

destroy the copy.
